INFORMATION UNDER ART. 7, D.LGS. [ITALIAN LEGISLATIVE DECREE] 70/2003 AND ART. 3, EUROPEAN REGULATION 679/2016 (GDPR)

Under art. 7, d.lgs. 70/03, “Implementing Directive 2000/31/EC on certain legal aspects of information society services, in particular electronic commerce, in the Internal Market”, we hereby provide the following information:

INFORMATION ON THE PROCESSING OF PERSONAL DATA - ART. 13 REG. 2016/679

All personal data collected in this website and any other information referable to you, either directly or indirectly, are processed and used in compliance with the principles laid down in the Regulation 2016/679.

For the effects and purposes of the above Regulation, the CONTROLLER informs you that any data acquired through the website will be mainly processed by computerised means and procedures, for the following purposes:

Registration Data are required, and failure to provide all or part of the data expressly indicated as necessary to pursue the stated purposes will result in the impossibility for Marcolin Covering s.r.l to answer your questions. The legal basis for the processing lies in art. 6 (1) (b) of Reg. 2016/679, that is, when processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract. The data you provide may only be disclosed to employees of Marcolin Covering s.r.l specifically authorised to process such data as persons in charge of the processing, and in any event, for the only purpose of completing activities you have requested. The persons in charge are bound by secrecy and confidentiality obligations, also based on an internal regulation on this subject. In any event, your data will never be disclosed to third parties. The data you provide will be kept for the time indicated by the relevant laws and regulations.

The Data controller is Marcolin Covering s.r.l - Via O. Michelin 3, 33170 Pordenone PN, Italia in the person of its personal representative. You may contact this latter to enforce your rights under articles 15, 16, 17, 18, 20, 21, 77 of Reg. 2016/679. The exercise of the above rights is subject to the limitations, rules and procedures laid down in the indicated Regulation, which you are bound to known and implement. In compliance with the provisions of article 12 (3), moreover, the Controller shall provide information to the data subject on action taken without undue delay and in any event within one month of receipt of the request. That period may be extended by two further months where necessary, taking into account the complexity and number of the requests. The controller shall inform the data subject of any such extension within one month of receipt of the request, together with the reasons for the delay.

This policy is also provided as EXTENSIVE INFORMATION, compared to the shorter text included in the business forms of Marcolin Covering S.r.l. In this regard, we point out the following:

In order to protect the legitimate interest of the controller to maintain a communication channel with the Customer, Marcolin Covering S.r.l. may use the Customer’s contact details to occasionally transmit information regarding its business. The Customer is entitled at any time to tell us if s/he no longer wishes to receive such communications.

2) MANDATORY OR OPTIONAL NATURE OF PROVIDING DATA

Providing your data for the purposes just described is mandatory, and refusal to provide them, or providing inaccurate data, might result in the contract not being stipulated or properly performed in accordance with the law.

3) STORAGE PERIOD

Accounting and fiscal data of customers and suppliers will be kept for ten years as required by the law; in any event, the storage period will be defined based on the laws applying to each processing activity or on whether the purpose has been achieved. The controller points out that data are also stored for the purpose of allowing exercise, defence or enforcement of its rights.

4) RECIPIENTS OR CATEGORIES OF RECIPIENTS TO WHOM PERSONAL DATA MAY BE DISCLOSED

In pursuing the purposes listed above, the personal data of customers and suppliers may be made known to specifically authorised employees of the controller. These persons are bound by an obligation of secrecy and confidentiality also based on specific internal Rules. Only data that are strictly required for accounting and financial operations may be disclosed, based on a legitimate interest of the Controller, to a professional advisor of its choice. If it is strictly necessary, your data may be disclosed to couriers or shipping agents (for the shipment of goods), suppliers of materials and parts or retailers (for after-sales service and warranty), banks (for payments), insurance companies (to handle any risks insured) and, more generally, to all recipients to whom disclosure of data is necessary for the achievement of the above-mentioned purposes.

5) RIGHTS OF THE DATA SUBJECT

The data subject (natural person, to whom the personal data refer) may at any time exercise his or her rights by addressing the Data Controller Marcolin Covering S.r.l., under arts. 15 and ff. of the GDPR, and in particular to obtain access to such data, confirmation as to whether or not data concerning the data subject are being processed, or to obtain the updating, rectification, erasure or restriction of the processing of personal data or to object to their being processed, or to obtain the data portability. The same articles also provide for the data subject’s right to lodge a complaint with the competent European Supervisory Authority; in Italy, this is the Data Protection Authority.

Marcolin Covering s.r.l uses third-party cookies, in particular cookies issues by Google Analytics services (used by Google to collect and then provide information, in aggregate form, regarding the number of users and how the same visit the website). The information generated by the cookie on the use of the website are communicated to Google Inc. It is also possible that third-party cookies may be used on the website, originating from Facebook, Twitter and Youtube, which are not on the website servers, and therefore are not sent by the website on the user’s terminal. These cookies are enabled if the user clicks on the FB, TW or YT icon, or enters their respective social sites, or uses the relevant services in API.
